These Terms & Conditions (“Terms”) govern the rental of portable restrooms and related equipment (“Units”) from Midwest & South Porta Potty Rentals (“Company,” “we,” “us,” “our”) and the use of our website. By booking a rental, requesting service, or using this website, you agree to these Terms.
1. Rental Agreement and Booking
A rental is confirmed once the Company accepts your order and schedules delivery. Quotes are subject to availability, routing, and site conditions. The customer (“you,” “Customer”) is responsible for providing accurate delivery details including city/state, address, dates, and placement instructions.
2. Delivery and Placement
- Customer must provide safe and reasonable access for delivery and pickup vehicles.
- Delivery times are estimates and may be affected by traffic, weather, road closures, or operational constraints.
- Customer is responsible for identifying an appropriate placement location. Units should be placed on stable ground with reasonable truck access.
- If the requested placement location is inaccessible upon arrival, additional fees may apply for re-delivery or repositioning.
3. Rental Period and Pickup
The rental period begins upon delivery and ends upon pickup. Pickup is scheduled based on routing and operational availability. Customer must ensure Units are accessible for pickup (gates unlocked, vehicles moved, no obstructions).
4. Use, Care, and Prohibited Activities
Customer agrees to use Units only for their intended purpose. Prohibited activities include, but are not limited to:
- Moving Units without Company approval
- Disposing of prohibited items (construction debris, chemicals, oils, hazardous waste, batteries, etc.)
- Vandalism, misuse, or intentional damage
- Using Units in a way that violates laws or local regulations
Customer is responsible for any damage beyond normal wear and tear, including theft, fire, or vandalism while Units are under Customer’s control.
5. Cleaning and Servicing
For long-term rentals, servicing schedules may be agreed upon (e.g., weekly). Customer must provide reasonable access for servicing. If access is blocked, the Company may skip service and/or charge a trip fee.
For event rentals, units are delivered cleaned and ready for use. Extra servicing during multi-day events may be available for an additional fee.
6. Fees, Payments, and Taxes
Pricing depends on unit type, quantity, rental length, servicing frequency, delivery distance, and site conditions. Customer agrees to pay the quoted amount plus any applicable taxes and approved additional fees (e.g., extra servicing, re-delivery, difficult access).
Late payments may be subject to additional charges as permitted by law.
7. Cancellations and Rescheduling
Cancellations and rescheduling requests should be made as early as possible. Depending on timing and routing commitments, cancellation fees may apply. Same-day cancellations may be billed due to dispatch costs.
8. Limitations of Liability
To the maximum extent permitted by law:
- Company is not liable for indirect, incidental, special, consequential, or punitive damages arising from rental or use of Units.
- Company’s total liability for any claim related to the rental shall not exceed the amount paid by Customer for the rental period at issue.
- Customer assumes responsibility for site conditions and placement location.
9. Indemnification
Customer agrees to indemnify and hold harmless the Company from claims, damages, or expenses arising out of Customer’s misuse, negligence, violation of law, or breach of these Terms.
10. Weather, Force Majeure, and Uncontrollable Events
Company is not responsible for delays or failures caused by events beyond our control, including severe weather, storms, road closures, supply chain interruptions, or emergencies.
11. Website Terms of Use
Website content is provided “as is” and may be updated without notice. You agree not to misuse the website, attempt unauthorized access, or submit false information.
12. Governing Law
These Terms are governed by applicable laws in the jurisdiction where the rental is delivered and performed, which may vary across Midwest & South service locations.
